Welcome to VelvetSearch. These Terms of Service ("Terms") govern your access to and use of the VelvetSearch mobile application (the "App"), operated by VelvetSearch ("we," "us," or "our"). By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Your account

To use certain features of the App, you'll need to create an account. You're responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately if you suspect any unauthorized use of your account.

3. The service we provide

VelvetSearch allows you to search for products by uploading or capturing photos, by text search, and by browsing a discover feed. We use third-party image recognition and search technology to identify items and locate where they may be purchased, along with pricing information across participating retailers.

VelvetSearch is a discovery and comparison tool. We are not a retailer, and we do not sell, ship, or fulfill any products ourselves. All purchases you make are completed directly with the third-party retailer, subject to that retailer's own terms, pricing, and policies.

4. Accuracy of results

We work to provide accurate product matches and up-to-date pricing, but we cannot guarantee that search results, prices, availability, or product details are always complete, current, or error-free. Prices and availability shown in the App may differ from what you see when you complete a purchase on a retailer's site.

5. User content

When you upload photos or submit searches, you grant us a limited license to use that content solely for the purpose of operating and improving the App's search functionality. You retain ownership of any photos you upload. You agree not to upload content that is unlawful, infringes on someone else's rights, or that you do not have permission to share.

6. Acceptable use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms
• Attempt to reverse-engineer, scrape, or interfere with the App or its underlying systems
• Upload content that is harmful, abusive, infringing, or otherwise objectionable
• Use automated means to access the App without our prior written permission
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity

7. Third-party services and links

The App relies on third-party services, including image recognition and product search providers, and links out to third-party retailer websites to complete purchases. We do not control and are not responsible for the content, policies, or practices of any third-party service or website. Your interactions with those third parties are solely between you and them.

8. Price alerts

Price-drop alerts are provided as a convenience based on data available to us at the time. We do not guarantee the accuracy or timeliness of any price alert, and pricing may change before you complete a purchase.

9. Intellectual property

The App, including its design, branding, and underlying technology, is owned by VelvetSearch and protected by applicable intellectual property laws. Except for the limited rights granted to use the App as intended, no other rights are granted to you.

10. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access to the App if we believe you've violated these Terms or if we discontinue the App.

11. Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or that search results will be accurate or complete.

12. Limitation of liability

To the fullest extent permitted by law, VelvetSearch will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including any losses related to purchases made through third-party retailers found via the App.

13. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you through the App.
