Terms of Service

These terms are an agreement between you and Evangelina Castorena, doing business as VelvetSearch ("VelvetSearch," "we," "us"), for your use of the VelvetSearch app and website. By creating an account or using VelvetSearch, you agree to these terms and to our Privacy Policy.

1. Who can use VelvetSearch

You must be at least 13 years old. If you are under 18, you need permission from a parent or guardian, and they agree to these terms on your behalf. VelvetSearch is currently offered in the United States only.

2. Your account

Keep your login details private and let us know right away if you think someone else has used your account. You're responsible for activity on your account. You can delete your account at any time in the app.

3. What VelvetSearch is

VelvetSearch is a search tool. It uses image recognition and text search to help you find products and compare prices at other stores. We are not a retailer. We don't sell, ship, or fulfill any products, and any purchase you make is between you and the retailer, under their terms.

4. Results, prices, and availability

Results come from third-party sources and are identified partly by AI, which can make mistakes. We work to keep results accurate, but we can't guarantee that product matches, prices, sizes, availability, or other details are always complete, current, or correct. Check the details on the retailer's site before you buy.

Price alerts are a convenience. We don't guarantee that an alert will be accurate, on time, or sent at all.

5. No ads, and how results are ranked

VelvetSearch has no ads on any plan. Results are ordered by how well they match your search and by price. Some retailer links may be affiliate links, meaning we may earn a commission if you buy something. Commission never affects which results you see or their order, and retailers cannot pay to appear or rank higher. See How VelvetSearch makes money.

6. Free and Pro plans

Free: unlimited searches, results, and boards, plus Compare Price up to 3 times per month.

Pro: unlimited Compare Price, price alerts, the weekly digest, full search history, and push notifications. Pro costs $4.99 per month or $39.99 per year in the United States. Prices shown in the App Store at the time of purchase apply.

• Pro is billed through your Apple account when you confirm your purchase.
• Your subscription renews automatically at the same price and length unless you cancel at least 24 hours before the end of the current period.
• You can manage or cancel your subscription in your iPhone's Settings, under your name, then Subscriptions. Cancelling stops future renewals. You keep Pro until the end of the period you've paid for.
• Payments and refunds are handled by Apple under Apple's policies. We can't issue refunds directly.
• If we change Pro pricing, we'll tell you in advance, and you'll have the chance to cancel before the new price applies.

Features included in each plan may change over time.

7. Beta program

During our beta, a limited number of early members, up to 50, get Pro features free. When VelvetSearch launches, beta members will be offered Pro for $19.99 for their first year. After that first year, the regular Pro price applies unless you cancel. The exact launch offer will be shown in the app before you're charged anything.

Beta versions may have bugs, missing features, or interruptions, and features may change or be removed. We may end the beta at any time. If you send us feedback or ideas, you let us use them to improve VelvetSearch without owing you anything.

8. Your content

You own the photos you take and upload. You give us permission to use them to run your searches and provide the app's features, including sending them to the providers described in our Privacy Policy. Search photos are deleted about one minute after your search. You're responsible for making sure you have the right to use any photo you upload.

If you report a listing, we may review it and remove or hide it for you or for everyone.

9. Things you can't do

• Break the law or help anyone else break it.
• Scrape, copy, or collect data from VelvetSearch, or access it with bots or automated tools, without our written permission.
• Try to break, overload, or get around the security of VelvetSearch.
• Upload anything illegal, harmful, or that you don't have the right to use.
• Pretend to be someone else, or misuse reports to target retailers.
• Resell or repackage VelvetSearch or its results.

10. Third parties

VelvetSearch links to retailers and relies on third-party services. We don't control them and aren't responsible for their content, products, policies, or practices.

11. Our property

The VelvetSearch app, name, logo, and design belong to us. Product names, images, and brands shown in results belong to their owners and are shown to help you find products.

12. Disclaimers

VelvetSearch is provided "as is" and "as available." To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise that VelvetSearch will be uninterrupted, error-free, or secure.

13. Limitation of liability

To the extent the law allows, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for anything related to a purchase you make from a retailer. Our total liability for any claim related to VelvetSearch is limited to the greater of the amount you paid us in the 12 months before the claim, or $50.

14. Ending your use

You can stop using VelvetSearch and delete your account at any time. We may suspend or end your access if you break these terms or if we need to for legal or safety reasons. Deleting your account doesn't cancel an Apple subscription. Cancel that in your iPhone's Settings.

15. Changes to these terms

We may update these terms. We'll change the date at the top, and for significant changes we'll let you know in the app or by email before they take effect. If you keep using VelvetSearch after that, the new terms apply.

16. Governing law

These terms are governed by the laws of the State of California. Any dispute will be handled in the state or federal courts located in San Diego County, California, unless the law where you live requires otherwise.

17. Apple App Store

If you downloaded VelvetSearch from the Apple App Store:

• These terms are between you and us, not Apple. We, not Apple, are responsible for VelvetSearch and its content.
• Your use of the app must also follow the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. Apple has no other warranty obligation for the app.
• Apple is not responsible for any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
• Apple is not responsible for investigating, defending, or settling any claim that the app infringes someone's intellectual property.
• You confirm you are not located in a country subject to a U.S. government embargo, and you are not on any U.S. government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
